Conditions of Use
1. INTRODUCTION
MMV – Miguel Mora do Vale & Associados – Sociedade de Advogados, SP, RL (hereafter “MMV”), is a law firm with its registered office at Rua Castilho, n.º 32, 8º, 1250-070 Lisboa, Portugal, with tax number 514547995.
MMV owns all the intellectual property rights or rights of any other type over the Site www.mmvadvogados.pt (hereafter, the “Site”) and MMV’s applications (hereafter, “Applications”), access to and use of which by users (hereafter, “User” or “Users”) is subject to these conditions of use (hereafter, “Conditions of Use”), which will be complemented with any other legal texts that govern any functionality, service, process, application, platform or means necessary for the use of the Site or the Applications or connected to them.
2. OBJECT
The Site and the Applications contain material prepared by MMV merely for information purposes. The information, articles and any other publications on the Site are up-to-date on the date of their last publication and may not reflect the most recent situation in the legislation or case law on the issues analysed.
The material contained on the Site and/or on the Applications may not be used, under any circumstances, as a substitute for legal advice or advice of another kind.
Access to this Site does not aim to establish, nor does it imply, any relationship between a lawyer and a client, or any other type of relationship of trust or professional relationship between MMV and the User of the Site and/or Applications. If the User intends to obtain legal advice, he should consult MMV directly.
3. IMPROPER USE
By accessing the Site, the User agrees to comply with these Conditions of Use, and to comply with the special warnings or instructions for use contained in them and to always work in line with the legislation in force and the dictates of good faith and public order established, using due diligence and refraining from using the Site and/or the Applications in any manner that may prevent, harm or damage their normal functioning, or the property or rights of MMV, those of other Users or, in general, those of any third party.
4. LIABILITIES AND GUARANTEES
MMV will not be liable for any loss or damage that may result from browsing the Site and/or the Applications and/or consulting the information contained on the Site.
MMV reserves the right to interrupt access to the Site and/or the Applications at any time and with no advance notice. MMV does not check, in general terms, the use that Users make of the Site and/or the Applications.
MMV does not guarantee that there are no viruses or other harmful items that may cause damage or changes to the IT system, electronic documents or files of the user of this Site and/or the Applications. Accordingly, MMV will not answer for any loss and damage that those items may cause to the user or to third parties.
5. INTELLECTUAL AND INDUSTRIAL PROPERTY
All Intellectual and Industrial Property rights, and all the information contained on the Site and in the Applications (including their information, texts, data, images, graphs, drawings, source code, software, brands, navigation structures, databases, etc. and any other content that appears) is the exclusive property of MMV.
The User is expressly forbidden to reproduce, transmit, transform, distribute, publicly communicate, place at another’s disposal, extract, reuse, exploit or use, in any way, by any means or procedure, any of these, except in situations where he is legally permitted to do so or is expressly authorised by MMV in writing.
6. DATA PROTECTION
MMV will protect the personal data of Users and will use it only insofar as is permitted by law and whenever Users have given their consent. For further information, please consult the Privacy Policy.

8. ACCESS TO THE SITE
Access to the Site and to the Applications implies acceptance by the User of the provisions set out in these Conditions of Use.
MMV reserves the right to modify or update these Conditions of Use at any time, and also any type of information that may appear on the Site and/or the Applications.
COOKIES POLICY
The User is informed that this Site uses cookies and similar technology. Cookies are small data files placed on the User’s device that allow information to be stored related to the navigation engaged in. In particular, cookies allow this Site to know, among others, the following information:
• The date and time of the last time the User visited the Site;
• The type of content that the User chose on his visit to the Site;
• Security elements that operate in controlling access to restricted areas. The User has the option to prevent cookies being created, by selecting the corresponding option in the configuration of his browser.

The Site does not use third party cookies other than for statistical data regarding visits to the site.
PRIVACY POLICY
CONTROLLER
MMV, the data controller of personal data submitted via the site www.mmvadvogados.pt (the “Site”), has a firm commitment to the privacy and to the rights of data subjects, and acts in line with the provisions set out in the General Data Protection Regulation (“GDPR”) and other applicable legislation.
MMV guarantees that personal data is only processed within the scope of the purposes for which it has been collected, and MMV only collects, uses and stores minimal personal data that is necessary and sufficient for the purposes in question.
PURPOSE AND GROUNDS FOR PROCESSING PERSONAL DATA
MMV may process personal data for the following purposes and with the following legal grounds:
a) For the provision of advocacy services, in the interest of MMV in the processing of the information of its clients, in a sustained and efficient manner, and in the interest of the clients represented by MMV as part of the performance of the representation and legal assistance, communications with the client, with other parties and/or public entities, including courts, and filing of documents in digital format and on hard copy.
b) For communications and to send information, including disclosing information of a legal nature, to respond to requests from those filling out forms on MMV’s website and to adjust the respective communication.
c) To manage recruitment applications, for presentation of applications in MMV’s recruitment processes.
d) To comply with legal obligations
e) For invoicing and accounts management, to perform a contract and to comply with legal obligations.
PERSONAL DATA STORAGE PERIOD
MMV will only store your data for the period necessary to comply with the respective purposes or during the period that is required by the applicable laws or regulations. The time periods for storing personal data, according to each reason for processing, are the following:

MMV does not transmit your personal data to third parties, except in situations where this proves necessary for the provision of the services you have contracted or for compliance with legal obligations and/or decisions of the judicial and administrative authorities that are imposed on it.
PERSONAL DATA PROTECTION
MMV has a strict security policy, from the technical and organisational point of view, in order to protect personal data from being destroyed, lost, altered, disclosed or accessed without permission and against any other form of illegal or abusive processing.
The technical and organisational security measures implemented by MMV are also required of MMV’s service providers and collaborators.
RIGHTS OF THE DATA SUBJECT
In the terms of the applicable legislation, the data subject has the right to access, rectify, erase, restrict processing, request portability of data, oppose, not be subject to automated individual decisions, withdraw consent, and present complaints to the National Commission for Data Protection (www.cnpd.pt).
Exercise of the aforementioned rights may be limited due to the existence of rights and freedoms of third parties, legal obligations or obligations of confidentiality and prevailing legitimate interests of MMV or of a third party, in the terms of the legislation in force.

We support all the initiatives of lawyers at our firm regarding the exercise of advocacy that upholds values, defending and supporting societal causes.
Solidarity is present in our organisation and we provide legal support pro bono, although we do not like to publicise this.
